✅ 1. Acceptance of Terms

Welcome to Mirage Mind. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Mirage Mind ("we," "us," or "our").

By downloading, installing, accessing, or using the Mirage Mind mobile application (the "App"), you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must immediately cease using the App and uninstall it from your device.

🔞 2. Eligibility & Age Requirements

You must be at least 13 years of age (or the minimum age of digital consent in your jurisdiction, whichever is higher) to use Mirage Mind. By using the App, you represent and warrant that you meet this age requirement.

If you are between the age of majority in your jurisdiction and 18, you may only use the App with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms.

🔑 3. Account Registration & Security

To access certain features, you may need to create an account. You agree to:

• Provide accurate, current, and complete registration information.
• Maintain the confidentiality of your login credentials and never share them.
• Accept full responsibility for all activities that occur under your account.
• Notify us immediately at [email protected] if you suspect unauthorized access.

We reserve the right to suspend or terminate accounts that violate these Terms or remain inactive for extended periods.

🤖 4. AI Nature & Critical Disclaimers

Mirage Mind is an entertainment-focused AI chat application. You acknowledge and agree to the following fundamental aspects of the service:

• Fictional Characters: All character cards and AI personas are entirely fictional. They do not represent real people, living or deceased.
• Not Professional Advice: AI responses are generated algorithmically and may be inaccurate, misleading, or fabricated ("hallucinations"). Nothing in the App constitutes medical, legal, financial, psychological, or any other professional advice. Always consult qualified professionals for serious matters.
• No Emotional Dependency: The App is not a substitute for human interaction, therapy, or crisis support. If you are experiencing mental health distress, please contact a licensed professional or crisis hotline in your area.
• Unpredictable Outputs: Despite our safety filters, AI models can occasionally produce unexpected, offensive, or inappropriate content. We do not guarantee that all outputs will be suitable for all users.

🛡️ 5. Acceptable Use Policy

You agree NOT to use Mirage Mind to:

• Generate, solicit, or distribute illegal content, including CSAM, terrorism-related material, or content promoting violence.
• Create non-consensual intimate imagery, deepfakes, or sexually explicit content involving minors.
• Harass, bully, threaten, defame, or discriminate against any individual or group.
• Attempt to jailbreak, reverse-engineer, extract model weights, or bypass safety filters.
• Use automated scripts, bots, scrapers, or unauthorized APIs to access the App.
• Impersonate any person, entity, or Mirage Mind staff member.
• Upload malware, viruses, or malicious code through any input field.
• Use the App for commercial purposes without prior written authorization.

Violations will result in immediate account suspension and may be reported to law enforcement where applicable.

©️ 6. Intellectual Property Rights

All content, features, functionality, code, trademarks, logos, and AI models within Mirage Mind are owned by or licensed to us and protected by international intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the App solely for personal, non-commercial entertainment purposes. No other rights are granted.

💬 7. User-Generated Content

You retain ownership of the messages and prompts you submit. However, by submitting content, you grant Mirage Mind a worldwide, royalty-free, non-exclusive license to process, store, and display your content solely for the purpose of providing and improving the service.

You represent that your submissions do not infringe third-party rights or violate any laws. We reserve the right to remove any user content that violates these Terms without notice.

💳 8. Subscriptions & In-App Purchases

Mirage Mind may offer premium features via subscriptions or one-time purchases processed through Google Play Billing.

• Billing: Payments are handled entirely by Google Play. We do not store your payment card information.
• Auto-Renewal: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
• Cancellation: You may cancel anytime through your Google Play subscription settings. No refunds are provided for partial billing periods.
• Price Changes: We may adjust pricing with reasonable advance notice. Continued use after a price change constitutes acceptance.

⚠️ 9. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED/ERROR-FREE OPERATION.

We make no warranty that AI outputs will be accurate, reliable, safe, or suitable for any particular purpose. You assume all risks associated with your use of the App.

⚖️ 10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MIRAGE MIND SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO DATA LOSS, EMOTIONAL DISTRESS, OR FINANCIAL LOSS.

Our total aggregate liability shall not exceed the amount you paid to us in the twelve (12) months preceding the claim, or $50 USD, whichever is greater.

🛡️ 11. Indemnification

You agree to indemnify, defend, and hold harmless Mirage Mind, its affiliates, officers, and employees from any claims, damages, losses, or expenses arising from your violation of these Terms, misuse of the App, or infringement of third-party rights.

🚫 12. Termination & Suspension

We may suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Grounds for termination include but are not limited to breach of these Terms, fraudulent activity, or prolonged inactivity.

Upon termination, your right to use the App ceases immediately. Sections regarding disclaimers, liability limitations, indemnification, and dispute resolution survive termination.

🔄 13. Changes to These Terms

We may revise these Terms periodically. Material changes will be communicated via in-app notification or email. Your continued use after changes take effect constitutes acceptance.

If you disagree with updated Terms, you must stop using the App and delete your account.

🏛️ 14. Governing Law & Dispute Resolution

These Terms shall be governed by the laws of the jurisdiction where Mirage Mind is headquartered, without regard to conflict-of-law principles.

Any disputes shall first be attempted to be resolved through informal negotiation for 30 days. Thereafter, disputes shall be submitted to binding arbitration, except where prohibited by local consumer protection laws. Class action waivers apply to the fullest extent permitted by law.
